These Terms of Service (“Terms”) govern your access to and use of the website, online booking, and related services offered by BG Physical Therapy LLC, doing business as BGPT Physical Therapy (“BGPT,” “we,” “us,” or “our”), located at 3108 Palo Alto Dr NE, Albuquerque, NM. By accessing this website, booking a service, or purchasing a MoveRx membership, you agree to be bound by these Terms.

1. Description of Services

BGPT provides in-home physical therapy evaluations and treatment sessions delivered by a licensed Doctor of Physical Therapy in the state of New Mexico, as well as MoveRx home exercise membership plans. BGPT also plans to offer Alivara Recovery Balm, a topical relief and recovery product, in the future. These Terms apply to all current and future services offered through this website.

2. Cash-Pay Services Only

All services are offered strictly on a cash-pay basis. BGPT does not bill insurance, submit claims to any insurance provider, or provide superbills for insurance reimbursement purposes of any kind. You are solely responsible for the full cost of services at the time they are rendered, and for determining whether or how to seek reimbursement from any third party, if applicable.

3. Eligibility

You must be at least 18 years old to book services or enroll in a membership independently. Services for individuals under the age of 18 require the informed consent of a parent or legal guardian, who must be present or otherwise provide documented consent prior to treatment.

4. Booking, Payment, and Cancellation Policy

Appointments must be cancelled or rescheduled at least 24 hours in advance. Cancellations made less than 24 hours before a scheduled visit are subject to a late-cancellation fee of up to fifty percent (50%) of the value of that visit.

If a visit was part of a pre-purchased package or bundle of sessions, a visit cancelled with less than 24 hours’ notice will be counted as used against the pre-paid number of visits, regardless of whether the session took place.

5. MoveRx Membership Terms

MoveRx is a recurring membership program billed every 4 weeks, offered in Minimum, Standard, and Premium tiers as described on the MoveRx page of this website. A one-time start-up fee of $150 applies to Standard and Premium tiers and is waived for former BGPT patients.

BGPT may offer an option to waive the $150 start-up fee in exchange for a 6-month membership commitment. If a member enrolled under this offer cancels their membership before completing the full 6-month term, the previously waived $150 start-up fee will be charged at the time of cancellation.

Membership fees are billed automatically on a recurring basis until cancelled. You may cancel your membership at any time by contacting BGPT directly; cancellation will take effect at the end of the current 4-week billing cycle unless otherwise agreed in writing.

The content on this website, including descriptions of services, MoveRx, and any educational material, is provided for general informational purposes only and does not constitute medical advice. It is not a substitute for professional evaluation, diagnosis, or treatment. Booking a service through this website does not, by itself, establish a patient-provider relationship or constitute informed consent to treatment. Prior to receiving physical therapy services, patients are required to review and sign a separate Informed Consent for Treatment form, which discloses the nature of treatment, associated risks and benefits, and the patient’s rights, consistent with New Mexico physical therapy practice requirements.

7. Website Use and Intellectual Property

All content on this website, including text, graphics, logos, and the BGPT and MoveRx names and branding, is the property of BG Physical Therapy LLC and may not be copied, reproduced, or used without prior written permission. You agree to use this website only for lawful purposes and not to interfere with its operation or security.

8. Limitation of Liability

To the fullest extent permitted by law, BG Physical Therapy LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of this website or the information contained on it. Nothing in this section limits any liability related to the direct provision of physical therapy treatment, which is governed separately by the Informed Consent for Treatment executed with each patient and applicable New Mexico law.

9. Changes to These Terms

BGPT may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. Continued use of the website or services after changes are posted constitutes acceptance of the revised Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law principles.
